The purpose of this policy ("the Private Policy") is to:
- inform you who we are and how you can contact us; and
- explain how we collect, use, share and protect your personal information; and
- inform you about your rights and choices with respect to your personal information.
1.1 The purpose of this Privacy Policy is to give you information on how we collect and process your personal information when you use the Red Ant Agri Engineering Solutions software application ("the App").
1.2 Red Ant Agri Engineering Solutions ("Red Ant Agri") is a division of an agricultural business, Reid & Verwey (Pty) Ltd, which is registered in the Republic of South Africa, but also operates globally. Red Ant Agri, "us", or "our" in this Privacy Policy refers to the entity that is responsible for processing your personal information in South Africa.
2.1 "Personal information" means any information relating to an identified or identifiable living individual and, where applicable, an identifiable existing juristic person (like a company) as defined under the Protection of Personal Information Act 4 of 2013 ("POPIA"). Depending on who you are (e.g., a customer, supplier or business partner) and how you interact with us (e.g., telephone, online or offline), we may collect, use, receive, store, analyse, combine, transfer or otherwise process different categories of personal information.
3.1 You have acquired a product from Red Ant Agri, which encompasses the utilisation of GPS technology ('the Red Ant Smart Node') designed for use with your agricultural equipment, such as a Red Ant Smart Spreader or retrofit to an existing machine such as a mist blower or bulk material spreader for the purpose of precision control of such agricultural equipment.
3.2 The Red Ant Smart Node is paired with a separate Android device (which will not necessarily become your property), on which you will install the App.
3.3 This means that the App will track the location and performance of your Red Ant Smart Node and the agricultural equipment that is in turn controlled by this Red Ant Smart Node.
3.4 This will have the consequence that we will have access to a limited amount of your personal information, which we will deal with in this document.
4. WHAT TYPES OF PERSONAL INFORMATION DO WE COLLECT ABOUT YOU?

In principle, we do not collect any special categories of personal information about you (such as details about your race or ethnicity, religious or philosophical beliefs, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric information).
4.3 To the extent that our App may include links to third-party websites, plug-ins and applications (including cookies, tracking technologies and widgets by third-party advertisers), it is important that you understand that by clicking on those links or enabling those connections, you may allow third parties to collect or share data about you. Red Ant Agri does not have oversight of these third-party websites and we are not responsible for their processing of personal information.
5.1 The personal information we collect from you is limited to the specified information in paragraph 4 above.
5.2 We obtain the account log-in information from yourself via the log-in portal of the App.
5.3 The Red Ant Smart Node location is tracked through GPS technology. We reiterate that the App tracks the location of the Red Ant Smart Node, and only if the App is connected to a Red Ant Smart Node. It is essential to note that:
5.3.1 The App cannot track a physical location if the App is not connected to the Red Ant Smart Node; and
5.3.2 the Red Ant Smart Node is not linked to your personal smartphone or tablet, and therefore your physical location cannot be tracked.
6.1 We process personal information only when we have a valid legal ground to do so. Most commonly, we use your personal information where:
6.1.1 it is necessary to process your personal information in connection with the performance of a contract that we have with you directly or indirectly;
6.1.2 it is necessary for our legitimate interests (or the legitimate interests of a third party). We make sure that our legitimate interests do not override your fundamental rights;
6.1.3 we use your personal information to comply with our legal obligations.
6.2 We may seek your explicit consent where the applicable laws require us to do so.
6.3 There can be additional legal grounds for processing personal information in some countries. This depends on applicable law and the products and services offered to you.
7.1 To verify, authenticate and authorise your use of our products or services.
7.2 To protect our business and to ensure compliance with the law.
7.3 To manage our relationship with you.
7.4 If you contact us or otherwise give us your contact information (for example, by registering, by completing an enquiry form on our website/s, or by subscribing to receive support and service status communications from us or security or fraud monitoring alerts), we may process your personal information:
7.4.1 to inform you about your products or services with us and any changes to these products or services and any associated legal documents;
7.4.2 to notify you if there is any interruption of services or products;
7.4.3 to ask you to provide information on how we can improve or develop services or products and to otherwise effectively communicate with you;
7.4.4 to provide you with service assistance and problem solutions or to contact or send you notifications related specifically to the services or products we offer you;
7.4.5 to use your personal information in transactional or fraud monitoring reports (or both) as part of the performance of our contract. You have the option to unsubscribe from such reports in accordance with the terms of our contract. Be sure to check with your finance team before you unsubscribe.
7.5 To market our products and services and related services to you

7.7 We may use personal information that we collect:
7.7.1 to research and gain insights into market trends and needs and to develop or innovate our technologies, products and services to meet such market trends and needs.
7.7.2 to analyse visitor use of our Websites, Apps, products or services in line with this Privacy Policy and our Cookie Policy;
7.7.3 to improve and personalise our customer relationships;
8.1 We may share personal information with internal third parties, being third parties from the group of companies to which Red Ant Agri belongs. We may disclose your personal information to those companies to:
8.1.1 provide support services and technical services to these internal third parties and to receive some of these services from them;
8.1.2 contribute to the research, data analytics and studies in order to improve the products and services that Red Agri and other internal third parties respectively provide.
8.2 We may share your personal information with external third parties such as:
8.2.1 service providers or vendors under contract who assist us with our business operations;
8.2.2 companies that we plan to merge with or entities that we may be acquired by, in which situation we will require that the new combined entity or the acquiring entity follow this full Privacy Policy with respect to your personal information;
8.2.3 when required by law enforcement, government officials, fraud detection agencies or other third parties and when we are compelled to do so by law (such as via a subpoena, court order or similar legal procedure);
8.2.4 international entities we partner with for the offer and/or development of products and services subject to the requirements under this Privacy Policy and applicable laws.
9.1 We use cookies, web beacons and similar techniques ("cookies") when you access our App.
9.2 A cookie is a small piece of data (text file) that a website - when visited by a user - asks your browser to store on your device to remember information about you, such as your language preference or login information.
10.1 We are part of a global company with a global footprint.
10.2 Your personal information may be processed either locally in South Africa, where you work or reside, or in any other country where we or our approved third-party service providers operate worldwide, as permitted by law.
11.1 Should the App be connected to the internet, via Wi-Fi or Mobile Data, the App will not store any personal information other than the Operator ID with which you logged into the App. In this instance the information gathered from the Red Ant Smart Node will be transferred directly to the Red Ant IoT Portal.
11.2 It is the policy of Red Ant Agri, that the data will only by stored and retained on the App, should the App function without an internet connection. As soon as an internet connection is available, either through Wi-Fi or Mobile Data, then all data gathered by the App will be transferred to the Red Ant IoT Portal, which forms part of the business of Red Ant Agri, to which data transfer you consent. Subsequent to this, all data will be immediately erased from the App.
11.3 We will never store any information on the Red Ant IoT Portal for a longer period than is required for statutory, commercial or business reasons.
11.4 We however reserve the right to store your personal information for as long as required for the fulfilment of the purposes for which we collected it. The retention of personal information by us is determined by considering compliance with legal (contractual or statutory requirements), accounting and compliance reporting requirements.
11.5 We also take into consideration the temporary limits established in the commercial or data privacy laws, as well as in other relevant laws.
12.1 We ensure that you may exercise your individual privacy rights under applicable privacy and data protection laws. This means that we seek to provide reasonable assistance to cater to requests from individuals regarding the processing of personal information and the right to access, delete, erase, amend and withdraw permission to the processing of personal information.
12.2 You have the following rights:
12.2.1 access your personal information (access rights): You have the right to ask us if we process personal information that relates to you and you may ask us to provide you with details of the personal information we process about you (as required under applicable laws);
12.2.2 correct or rectify your personal information: You can ask us to have inaccurate personal information we process about you fixed or changed;
12.2.3 erase your personal information: You can ask us to delete or erase personal information under certain circumstances if the personal information is no longer needed for the purposes for which we collected them (subject to local data retention legal obligations);
12.2.4 withdraw your consent: You may withdraw your consent on condition that:
- The withdrawal of your consent does not affect the processing of your personal information before the withdrawal of your consent; or
- The withdrawal of your consent does not affect the processing of your personal information if the processing is following an obligation imposed by law on us; or
- The withdrawal of your consent does not affect the processing of your personal information where such processing is necessary for the proper performance of a public law duty by a public body; or
- The withdrawal of your consent does not affect the processing of your personal information as required to finalise the performance of a contract in which you are a party; or
- The withdrawal of your consent does not affect the processing of your personal information as required to protect your legitimate interests or our own legitimate interests or the legitimate interests of a third party to whom the information is supplied.
12.2.5 restrict the processing of your personal information: You can require certain personal information to be marked as restricted for processing in certain circumstances, such as an objection to our processing of your personal information based on our legitimate interests;
12.2.6 object to automated decision-making, including profiling, if these decisions produce a legal effect on you;
12.2.7 raise a complaint: You may raise a complaint at any time to the Information Officer.
13.1 The security of your personal information is important to us. We take legal, technical and organisational measures that we consider necessary in order to maintain the confidentiality and security of your personal information, with due regard to the applicable obligations and exceptions under the legislation in force.
13.2 We regularly review our policies regarding the collection, storage and processing of your personal information, including physical security measures, to prevent alteration, loss, query, use or fraudulent or unauthorised access to your personal information.
14.1 We do not voluntarily or actively collect, use or disclose personal information of minors under the age of 18 years, without the prior consent of the parents or guardians of the minor. Our services are not intended or designed to attract minors. If we learn that we collected the personal information of a minor without first receiving a verifiable parental consent, we will take steps to delete the information as soon as possible.
